Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Consumer: the natural person who is not acting for purposes related to their trade, business, craft or professional activity.
  • Entrepreneur: Edranza B.V., trading under the name Mister Truffle.
  • Distance Agreement: an agreement concluded between the entrepreneur and the consumer as part of an organized system for distance selling of products via the internet.
  • Right of Withdrawal: the consumer’s ability to withdraw from the agreement within the withdrawal period, where legally permitted.
  • Withdrawal Period: the period during which the consumer may exercise their right of withdrawal.
  • Products: all goods offered through the Mister Truffle webshop, including fresh magic truffles and related items.

Article 3 – Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every distance agreement concluded between Mister Truffle and the consumer. Before the agreement is finalized, the consumer will receive access to these terms and conditions. For electronic agreements, the consumer can easily save or download them.

Article 4 – The Offer

The offer includes a complete and accurate description of the products offered. Images and descriptions serve as a representative depiction. Obvious errors or mistakes in the offer do not bind Mister Truffle.

Article 5 – The Agreement

The agreement is established at the moment the consumer accepts the offer and complies with the associated conditions. After ordering, the consumer receives an electronic confirmation by email. Mister Truffle reserves the right to decline an order when legitimate reasons exist, such as suspicion of misuse or incorrect information.

Article 6 – Right of Withdrawal

Where legally permitted, the consumer may cancel an agreement relating to the purchase of non-perishable products within 14 days without providing a reason.

Please note: fresh products, including all magic truffles, are excluded from the right of withdrawal due to their limited shelf life. The sale of fresh truffles is final once payment has been successfully completed.

Article 7 – Obligations of the Consumer During the Withdrawal Period

During the withdrawal period, the consumer must handle the product and packaging with care. The consumer may only inspect the product to the extent necessary to determine its nature, characteristics and functioning.

Article 8 – Exercising the Right of Withdrawal

When the right of withdrawal applies, the consumer may contact info@mistertruffle.nl within the withdrawal period. The consumer must return the product within 14 days of the notification, in its original condition and packaging, at their own expense.

Article 9 – Obligations of the Entrepreneur in Case of Withdrawal

Upon a valid withdrawal, Mister Truffle will refund the purchase amount including any standard shipping costs within 14 days after receiving the returned goods, using the same payment method as used for the original purchase.

Article 10 – Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to products that:

  • spoil quickly or have a limited shelf life (such as fresh truffles);
  • cannot be returned for hygiene reasons once their seal has been broken;
  • are custom-made or specially assembled at the consumer’s request.

Article 11 – Price

All prices include VAT and are subject to adjustments required by law. During the validity period of the offer, prices will not be increased except due to changes in VAT rates.

Article 12 – Performance and Warranty

Mister Truffle ensures that all delivered products comply with the agreement and meet reasonable standards of quality and usability. Any complaints must be reported as soon as possible after receipt.

Article 13 – Delivery and Execution

Mister Truffle delivers with the utmost care. Delivery takes place at the address provided by the consumer. The standard delivery time is 1–3 working days within the Netherlands. If delivery is delayed, the consumer will be informed by email. The risk of damage or loss remains with Mister Truffle until the moment of delivery to the consumer.

Article 14 – Payment

Payment must be made using the payment methods offered on the website. The consumer is responsible for providing accurate payment information. Mister Truffle reserves the right to ship an order only after full payment has been received.

Article 15 – Complaints Procedure

Complaints regarding the execution of the agreement can be submitted by email within a reasonable time after detection, via info@mistertruffle.nl. Mister Truffle will respond within 14 days. If a complaint cannot be resolved within a reasonable period, the consumer may contact the European ODR platform at ec.europa.eu/odr.

Article 16 – Disputes

Agreements between Mister Truffle and the consumer are governed exclusively by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.

Article 17 – Additional Provisions

Additional or deviating provisions may not be to the disadvantage of the consumer and must be recorded in writing or in a manner that allows the consumer to store them on a durable medium.
